Creation by evolution?

We live in the universe and on the earth with its teeming life. How did all this come into existence? Did God create it in six days - the Biblical account? Or did it develop by chance through evolution over millions of years? No one was present in the beginning. Therefore we can only analyze the two possible scenarios taking into account our present scientific knowledge. What evidence can we present to a judge in a court case?
The fossil evidence. The fossil record of “millions of dead things laid down in rock layers all over the earth” (Buddy Davis, Creation Musical Adventures) is evidence of a world wide flood in Noah's day (Genesis 6-8). If life forms did change through millions of years, from one specie into another (for example fish into reptiles, dinosaurs into birds, or apes into humans) then we should find at least some of these transitions fossilized. But there are no such examples. The thousands of fossils in the world’s museums are fully formed species (D Gish, “The Fossils still say No! ICR, 1995).
The DNA evidence. Every living thing, whether insect, plant, reptile, et cetera, has its own genetic code in its DNA. This is a preprogrammed code and provides developmental instructions. No living thing can change its own genetic code. It is pre-programmed. God created living things after their own kinds (Gen 1:11-12, 21,24,25). No amount of breeding or mutations have yet succeeded in proving that the species barrier can be crossed (W Gitt, In the Beginning was Information, CLV, 1997; L Spetner, Not by Chance, Judaica Press, 1997). For example, despite hundreds of types of dogs, they remain dogs.
The irreducible complexity evidence. Microscopes become stronger as science develops. This enabled researchers to discover the incredible complexity of living things. The 'simple cell' for example, is extremely complex and functions like an engine. If any of the parts are still in process, it cannot do its job! It is therefore impossible that it could have developed step by step over millions of years of slow change (M Behe, Darwin's Black Box, Simon and Schuster, 1996). A living cell cannot be assembled step wise. It is an 'either, or' situation - either it is fully functioning, or it is not.
What would the judge's verdict be? (What do you think?) As it is, it is logical that God created in six days. It couldn't be otherwise. And He definitely did not use evolution.
